Question by Zonian: How do you pursue a claim against someone who did not fulfill a promissory note dealing with real estate?
Note (notarized) detailed I was to receive 8% interest on my investment (15K) in a property we owned jointly. Never received a payment. Property was recently sold, and now he states repair bills consumed all of the profit, so all I will get is my investment plus $ 1,000. These bills were supposedly for repairs due to a “meth/cocaine lab used on the premises in 2003. Never kept in touch or returned emails or phone calls. This response from him only came after I did my own research and found out the property had been sold a few days ago and I sent him a fax and email detailing everything. He wants a signed statement releasing him from the note. I’m hopeful I can pursue legal avenues if necessary with the note for at a minimum the rest of my interest owed. Property owned for 5 years. He now owns his own Real Estate company and took 4 years of tax benefits from the property. I was only given records for the first year to use.
To clarify, I did tell him I wanted the property sold, he just didn’t contact me when he did, and I don’t know when he would have. While the note stated we were joint owners, I don’t think I was ever placed on the title, so that left me as an investor. I was in the military, stationed overseas for many of those years. The was an acct were he was supposed to deposit the money, but claimed as erapirs came up he would said funds for repairs, since I was supposed to share on those repairs.
