the max sentence of 10 years. My brother was sentence in Carbondale for the same, while attending SIU. He also has a leadership, and gun enhancement.
Which The federal gov. retrieved no gun, no drugs and no money. He was sentenced to 15 years. Can he go back to court for resentencing under the new guidlines? If so what should we do to attempt to get the procedures started? How much will it cost?

Booker, Baker and Apprendi were the trilogy of cases that eliminated mandatory sentences in federal courts. You will need to hire an attorney, no way around it. This is not something you want to do on your own. The attorney will tell you how much it costs to retain him and whether its worth your time. It might cost a few hundred to a thousand for the initial research, then a few thousand more to actually get the appeal rolling.
