My ex and I are in a heated custody battle over our 6 month old daughter. I am asking for sole custody for myself and supervised visitations for him. He’s demanding joint custody and equal visitations. My ex has had an on/off relationship with another woman over 2 years and apparently Social Services was called over an alleged abusive situation between him and his on/off girlfriend’s son. I have a text message from her stating he has ‘put his hands on her children’ that was dated April 9th of this year. On a recent visit that I allowed between he and our daughter, he received a phone call (on my cell) from a Social Worker about alleged drug usage (or so he said they told him) and was asked to go to the local State Police Barracks to speak to them. He returned to my residence after this meeting with papers that had “Child Abuse/Neglect” written at the top but took them out of my hand before I could read what it was. He refuses to tell me what it was about. Yesterday I received a call from the Social Worker he spoke with who was trying to reach him. I asked him if this had anything to do with my child and they said no but then asked me what all he had told me. I told them nothing and I could tell he wanted to tell me, but was unable to. He did ask if I knew his birthdate and his Social Security Number for a background check to be performed on him. With the custody/visitation court case, would I be able to petition to have this matter brought into court to back up my case? I have other proof to back up my custody/visitation wants, but with the paperwork that I was able to see briefly, I am worried that he has in fact abused his former girlfriend’s (they are on an off period now) children. I reside in Kentucky if this helps.

It’s definitely relevant information for the judge to see, but it is not the court’s responsibility to provide you with your supporting evidence. I’m not saying they won’t, because family court has greater flexibility than criminal courts, but it’s too important to depend on that happening. I’d first try to talk to the social worker who is in contact with your ex and ask her how to get these records (or her) in front of the judge.

If in another county, do a Google search for: Your county Kentucky family court
and look for a listing with “.gov” in the address
If all else fails you can probably subpoena the records without a lawyer. The court clerk’s office can give you the forms.Like in everything else, some clerks are more helpful than others.
