Can He Get Custody if He Is Unfit?
Question by ATD926: Can he get custody if he is unfit?
I had a baby in December and had to leave the father in March, due to his drug abuse, mental abuse, and my safety (he threatened to kill me). He was in the Navy, but got the boot (honorable, somehow) due to his mental state. He was on deployment and went crazy and had to be sent to a psychiatric unit, then shipped back home and was admitted there. After I left, we were in agreement with everything – visitation, etc. Now, that he is back, he has been arrested for fraud, forgery and theft – for drugs. He is out of jail and on 2 years of probation. He never called to check on our son, he is supposed to hold a full time job – hasn’t got one yet. He is currently going to a methadone clinic every day, not paying child support, no job and living with his parents, which are unstable as well. I know it’s a stupid question, but should I be worried about custody? I filed for divorce and have an attorney, but since I have retained an attorney, his family has retained him one to fight me. Does he have a chance? I work full time, pay insurance, day care, formula, diapers, all expenses, plus my own. I also have a place for us to live, where our son has his own room. Also, he has my things and told me I cannot have them until I drop the protection order. Can he do this? Just a little concerned. Thanks
