Question by Matt H: I was arrested with less than a gram of heroin and I am on probation. Will going to rehab save me from jail?
I am currently on probation and on house arrest from a conspiracy to distribute charge that was actually me friend’s but it was my car. I still am at fault for putting myself in that situation. Anyways, I have been clean for 4 months and I am one month from getting my Associates Degree in Electronic Engineering and a few weeks from my evaluation at my job that should result in a raise. I have been doing great but this past weekend I was involved in an accident with an oversize load truck. Well I got terrible whip lash but did not want to go to hospital because it was my fault and i do not need the extra bills just to get prescribed 600mg ibuprofen. I fell off the wagon and was caught snorting heroin in my car, to ease the pain in my neck. If I go to an inpatient rehab for 2 months will that save me from jail time. No offense but I would prefer answers from those who may have experience in this type of situation, not COMMENTS from people who do not understand addiction. Thanks.

That is something an attorney could answer better for you but I will give you my .01 impression. Since you were on probation and you violated your probation by snorting heroin there is a good chance that you will serve the rest of your sentence in jail and possibly serve time for possessing heroin. It is possible that inpatient rehab might spare you jail but given your circumstances my ‘gut’ feeling says you will go back to jail.
