Question by James: If a cop enters a house without a search warrant, and without anyone saying they can come in, is that illegal?
So, today I was hanging out with the step brother, and a couple that was staying at his house for a few days, and they got in an argument and the girl slapped the guy, and he called the cops, and then left. The only people that were there were My step brother ( 21 ) My step sister ( 15 ) Her friend ( 15 ) and me ( ? ) and then the girl that slapped the guy ( 18 ) . Well, 3 cops show up, and just walk in without knocking, or even asking to come in and they didn’t even have a warrant, my step sister asked them if they had a warrant, and they said no, so she asked them to leave, and they said they had to check the house for ” any bodies they are trying to hide ” So, they searched the house ( without a warrant ) checked the rooms, and did a sweep of the whole house basically. I was in the basement asleep and my step brother had just gone upstairs to use the bathroom when they came in, and a cop walks downstairs, searches around with his flashlight shining it in my damn face. My step brother walks downstairs and the cop sees a bit of weed on the table and a few bongs. The cop asked him if it was weed, and he said yeah and the cop didn’t really care. So, he asks us to walk upstairs, and just chill in the living room. Might I remind you that they were in the house without a search warrant, on a ” Domestic Violence ” call, and had been asked to leave. So, one of the cops smell marijuana and starts looking around the house, well she finds a safe, and asks,” Who knows the combination for this safe?” well, my step brother says that it has nothing to do with what was going on, and says they would need a search warrant. Meanwhile, me my step sister, and her friend and the other girl, were in the living room sitting on the couch. The cop says that she would get a search warrant, and whatever. Well, by that time I had left. A little while later, I’d say 20-25 minutes, they have 15 cop cars, and a fire truck over there. They had the warrant, and they were going to pry the safe out of the ground. Meanwhile, My stepsister and her friend are sitting on the couch, being held hostage not being able to leave, or get up off of the couch. Remember, the original three cops that were in the house, were called for ” Domestic Violence ” The girl ( 18 ) and her boyfriend ( not sure his age ) Nothing happened to them, they didn’t go to jail, or anything. They didn’t even resolve the problem, nor did they ask about the damn situation. So, eventually my step brother opened the safe and found 10 or so ounces of weed, and about 1000$ USD. So, they did a more ‘ thorough ‘ search of the house, and completely destroyed my step sisters room. They threw all of her clothes on the ground, broke her bed, threw things all over the floor, and spilled chocolate milk on the ground and the clothes. Confiscated her friends purse, nothing being in it as far as drugs. So, my step dad went over there to pick up my step sister and her friend, and he asked the cop if they had a search warrant to be in the house ( this was before they had the warrant, sorry for the time frame being messed up ) or something like that, or if my step sister had let them in. Well, my step sister said she didn’t, and the cop flat out said she was a liar. So, time change! My step brother got his lawyer and all of that, and asked what his bond was, and they said the cops had found 10 POUNDS of marijuana and that he was unbondable ( ? ) Anyways, my question is, can the cops use anything they find in a house that they have no permission being in, and can they get a warrant to for a safe, being in a house, they aren’t allowed in? If that makes any sense . They just walked in, without a warrant and they were asked to leave. Also, this is in Louiville, Kentucky. Just happened today, March 9, 2013.
