Question by Sonya: Why is date rape a lesser charge than rape?
Does anyone know how the law distinguishes the two?

date rape is not a crime unto itself. sexual battery is sexual battery. Florida has a provision in our laws that separates a rape from a situation where a woman (or man, for that matter) is somehow drugged to make them vulnerable. That is treated as an aggravating factor.
