So my brother is a drug addict, heroin, roxies, etc. and finally got arrested after disappearing for over a week. He was charged today with caps-traffic, charge comment: no show, reckless driving. I decided to educate myself and found that in Florida the sentencing for reckless driving can include being sent to a rehabilitation center if it is discovered he was under the influence of drugs or alcohol. I just convinced my mother not to bail him out and wait for the rest of the family to sit down and talk about what we’re going to do about him. He likely has a lot more charges against him soon, drug trafficking, no show, etc. So any legal suggestions as to how I can help him? Would it be wise to inform the court he has a history of drug problem?

Yes, it would be very wise to tell the court of his problem and when you do that, write down specific incidents you all remember. It is very powerful when family makes formal statements in writing on behalf of a family member.

You should call a criminal lawyer with experience getting people into rehab ASAP. Talk to several and never go with the first one you talk to. Many lawyers are like salesmen—they sell the sizzle and not the steak. So you get hooked in on “sizzle” and then in court the guy or gal is an idiot.

And do call the courts and see if the court clerk or police can give you more information on how to help your brother. You have taken a really smart approach to this!
